Warranty

Return

RMA (Return Merchandise Authorization)

An RMA is a return authorization number issued by the supplier before shipping a returned product. This number must appear on the packaging and documentation accompanying the return. Without an RMA, the supplier may refuse to accept the merchandise.


Canadian Legal Framework

Competition Act (Canada)

The Competition Act (R.S.C., 1985, c. C-34) governs business practices in Canada, including misleading representations concerning warranties. Section 74.01 prohibits false or misleading representations about the benefits of a product, including the scope of a warranty.

Civil Code of Québec

The Civil Code of Québec (articles 1726 to 1730) imposes legal warranties applicable to all sales contracts, including:

Warranty of quality (article 1726): the seller must guarantee that the property is free of latent defects
Warranty of durability (article 1729): the property must be able to serve the use for which it is intended for a reasonable period

Consumer Protection Act (Québec)

The Consumer Protection Act (RLRQ, c. P-40.1) provides additional protections for consumers, including remedies in cases of non-conformity.

National Standards

Although warranties are not directly governed by technical standards such as the Canadian Electrical Code, Part I (CE Code) or CSA B149.1 (Natural Gas and Propane Installation Code), these standards define the safety and performance requirements for parts. Types of Warranties in the Parts Industry

Original Equipment Manufacturer (OEM) Warranty

Extended Warranty

Prorata Calculations

Prorata Principle

Prorata is a calculation method that determines the residual value of a part based on its usage relative to its expected service life. This method is commonly used for tires, batteries, and parts subject to wear.

Basic Prorata Formula

The general formula is:

Credit = (Remaining service life ÷ Total service life) × Purchase price

Example: A battery sold for $200 with a 60-month prorata warranty fails after 24 months.

Credit = ((60 − 24) ÷ 60) × $200 = (36 ÷ 60) × $200 = 0.60 × $200 = $120

The customer would therefore pay $200 − $120 = $80 for the replacement part.

Tire Calculation (Tread Depth)

For tires, prorata is calculated based on tread depth:

Credit = (Initial depth − Remaining depth) ÷ Initial depth × Purchase price

Example: A tire sold for $150 with an initial tread depth of 12 mm (12/32") has a remaining depth of 4 mm (4/32") at the time of the claim.

Credit = ((12 − 4) ÷ 12) × $150 = (8 ÷ 12) × $150 = 0.667 × $150 = $100

Kilometre-Based Calculation

Some warranties use kilometrage as the calculation basis:

Credit = (Maximum kilometrage − Kilometres travelled) ÷ Maximum kilometrage × Purchase price

Example: A shock absorber warranted for 80,000 km, sold for $120, fails at 50,000 km.

Credit = ((80,000 − 50,000) ÷ 80,000) × $120 = (30,000 ÷ 80,000) × $120 = 0.375 × $120 = $45

Handling and Shipping Fees

Restocking fees are charges billed by the supplier upon a return. They generally range from 15% to 25% of the purchase price. These fees do not apply to returns for manufacturing defects but do apply to returns for ordering errors or dissatisfaction.


Return Categories

Return for Manufacturing Defect

The product is defective from the factory or has a material or workmanship defect. The supplier assumes all costs, including shipping.

Return for Ordering Error

The customer ordered the wrong part. The supplier may accept the return, but restocking fees apply. The part must be in its original packaging, uninstalled, and in perfect condition.

Return for Overstock

The dealer or retailer returns surplus parts. Conditions vary by supplier:

Maximum time after purchase (often 90 days)
Maximum percentage of total purchase value
Exclusions (electrical parts, chemicals, special-order parts)

Return for Incorrectly Identified Part

The supplier shipped a part that does not match the order. The supplier assumes all costs and must ship the correct part as a priority.


Common Warranty Exclusions

Warranty on Rebuilt Parts

Typical warranties for rebuilt parts are:

6 to 12 months for electrical components
12 to 24 months for mechanical components
Limited duration in kilometrage (e.g., 20,000 km)

Core Exchange

Core exchange is a system where the customer pays a deposit (core charge) in addition to the price of the rebuilt part. This deposit is refunded when the old part (the core) is returned within a specified timeframe (generally 30 to 60 days). If the core is not returned, the deposit is retained by the supplier.


Pitfalls to Avoid
